To the extent that any legal proceeding is permitted under these Terms (including matters not subject to arbitration), you agree to submit to the exclusive personal jurisdiction of the competent courts of The Valley, Anguilla.
Binding Arbitration: Any dispute, claim or controversy arising out of or related to these Terms or your use of the Site, including the determination of the scope or applicability of this arbitration agreement, shall be resolved exclusively through final and binding arbitration administered by a recognised arbitration body under its rules in force. The arbitration shall be conducted by a single arbitrator in The Valley, Anguilla.
Class Action Waiver: YOU AND HANKSUGI AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN ITS INDIVIDUAL CAPACITY, AND NOT AS A CLAIMANT OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE THE CLAIMS OF MORE THAN ONE PERSON AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
Individual Claims Only: All claims must be brought in the parties' individual capacity and not as a claimant or class member in any class action, collective action or representative proceeding. This waiver also applies to class arbitration. Unless both you and Hanksugi agree otherwise, the arbitrator may not join or consolidate claims by or for more than one individual.
Exceptions: Notwithstanding the foregoing, either party may seek injunctive relief or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or breach of a party's copyrights, trademarks, trade secrets, patents or other intellectual property rights.
Costs: Each party shall bear its own costs and attorneys' fees in any arbitration proceeding, except where otherwise required by applicable law or determined by the arbitrator.
If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, unlawful or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
Hanksugi reserves the right to update, revise or modify these Terms at any time and at its sole discretion. When we make changes, we will update the "Last updated" date at the top of this page. Material changes may also be communicated through a notice on the main page of the Site or other appropriate means.
