Nothing on this Site grants, by implication, estoppel or any other means, a licence or right to use any registered trade mark, patent or other intellectual property of Hanksugi without specific written authorisation.
Tyre specifications, technical data, load ratings, dimensions, tread designs, performance features and other product information presented on this Site are provided for informational and general reference purposes only. They do not constitute a warranty, guarantee or representation of any kind regarding tyre performance under specific operating conditions.
Actual tyre performance may vary depending on factors including, but not limited to, vehicle type, load weight, road conditions, climate, driving habits, tyre maintenance practices and inflation pressure. These Terms and any dispute arising out of or related to your use of the Site shall be governed by and construed in accordance with the laws of Antigua and Barbuda, without regard to its conflict of laws principles.
To the extent that any legal proceedings are permitted under these Terms (including matters not subject to arbitration), you agree to submit to the exclusive personal jurisdiction of the competent courts of Saint John's, Antigua and Barbuda.
Binding Arbitration: Any dispute, claim or controversy arising out of or relating to these Terms or your use of the Site, including the determination of the scope or applicability of this arbitration agreement, shall be resolved exclusively through final and binding arbitration administered under the applicable rules of the Eastern Caribbean Supreme Court, with proceedings conducted in Saint John's, Antigua and Barbuda, before a single arbitrator.
Waiver of Class Action: YOU AND HANKSUGI AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTEDLY CLASS, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims of more than one person and may not preside over any form of collective or representative proceeding.
Individual Claims Only: All claims must be brought in the parties' individual capacities and not as a plaintiff or class member in any class action, collective action or representative proceeding. This waiver also applies to class arbitration. Unless both you and Hanksugi agree otherwise, the arbitrator may not join or consolidate claims by or for more than one individual.
Exceptions: Notwithstanding the foregoing, either party may seek interim or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation or breach of copyright, trade marks, trade secrets, patents or other intellectual property rights.
Costs: Each party shall bear its own costs and legal fees in any arbitration proceedings, except as otherwise required by applicable law or as determined by the arbitrator.
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, unlawful or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
Hanksugi reserves the right to update, revise or modify these Terms at any time and at its sole discretion. When we make changes, we will update the "Last updated" date at the top of this page. Material changes may also be communicated through a notice on the main page of the Site or by other appropriate means.
